ATTORNEY GENERAL J.B. VAN HOLLEN ANNOUNCES JUDGMENT REQUIRING A ST. CROIX COUNTY BUSINESS AND ITS OWNER TO PAY $29,444 IN PENALTIES AND STATE REIMBURSEMENT

 

MADISON — Attorney General J.B. Van Hollen has announced that his office has obtained a judgment against Gary J. Nagy and his business, St. Croix Truck and Trailer, LTD of the City of New Richmond for civil hazardous waste violations.  The judgment requires them to pay $15,000 in forfeitures, court costs, and mandatory surcharges and reimburse the Departments of Natural Resources and Justice $14,444 for their expenses of investigation and prosecution of the violations. 

 

According to the complaint, Mr. Nagy's business stored paint waste at its facility in New Richmond from its painting operations from the mid-1990’s forward.  This paint waste was properly removed by the defendants earlier this year.   This long-term storage was a violation of Wisconsin law because it was a hazardous waste and the defendants did not have a permit to store hazardous waste.    The complaint also alleges that Mr. Nagy and his business stored sand blasting sand waste at the facility without the necessary solid waste permit.

 

“Improper storage of hazardous waste can pose a threat to human health and the environment,” Van Hollen said.  “The state of Wisconsin takes these types of violations seriously as ensuring compliance with the regulations not only serves to protect people and our natural resources but also to maintain a level playing field for business.”

 

The case was investigated by the Wisconsin Department of Natural Resources.  Assistant Attorney General Steven E. Tinker represented the State.  The Stipulation and Order for Judgment was approved by St. Croix County Circuit Court Judge Scott R. Needham on October 17, 2014.
