AG Schimel Files Response to Labor Unions in Right-to-Work Case
MADISON, Wis. – Today, Attorney General Schimel filed the state’s response to the plaintiffs’ en banc petition in International Union of Operating Engineers Local 139 v. Schimel, a case involving two labor unions’ challenge to Wisconsin’s Right-to-Work law.
In July, the United States Court of Appeals for the Seventh Circuit upheld Wisconsin’s Right-to-Work law in this case, affirming the decision of the United States District Court for the Eastern District of Wisconsin.
In the brief filed today, Attorney General Schimel continues to argue that neither federal law nor the Constitution guarantees a union’s right to take money from non-union members. Further, the state argues there is no precedent for the United States Court of Appeals for the Seventh Circuit to hear the unions’ challenge en banc.
