James Shempert, of the Town of Madison, Charged with Two Counts of Possession of Child Pornography

MADISON — On Monday, January 13, 2014, a criminal complaint was filed against James Shempert, of 201 Deer Valley Road in the Town of Madison, charging him with two Counts of Possession of Child Pornography, a felony.  A preliminary hearing in this matter is scheduled for January 28, 2014, at 8:30 in the morning in Dane County Circuit Court.

According to the Criminal Complaint, on Thursday, January 9, 2014, special agents with the Department of Justice – Division of Criminal Investigation (DCI), with assistance from detectives with the Town of Madison Police Department, executed a search warrant at Shempert’s residence in the Town of Madison.  A DCI computer analyst performed an on-site forensic preview of digital devices located in the suspect’s apartment.  A review by a DCI special agent of a video and image located on a hard drive in a desktop computer in the suspect’s living room uncovered files consistent with child pornography, according to the complaint.  In an interview with agents, Shempert stated that he downloaded about five or 10 videos of child pornography, and deleted them after downloading the files.

Questions concerning this case should be directed to the Dane County District Attorney's Office.  A defendant enjoys the presumption of innocence.  The prosecution must prove its allegations at trial beyond a reasonable doubt.
