CALUMET COUNTY — Attorney General J.B. Van Hollen announced that Gabriel Martinez age 33 of Outagamie County was sentenced today in Calumet County Circuit Court after entering a plea of No Contest to an amended charge of Third Degree Sexual Assault by Judge Richard Nuss of Fond du Lac County.
Martinez, who has already served 11 months in jail, was sentenced to serve a period of probation for 5 years following his plea of no contest to fondling the private parts of an 11 year old girl. Martinez was ordered to serve an additional six months of county jail as a condition of probation. Martinez was also ordered to participate in alcohol and sex offender assessments and treatment. He was given a “No Drink” provision for the 5 year period and is to have no unsupervised contact with any female under 18 years of age.
Martinez's case was originally prosecuted by the Calumet County district attorney's office; but upon the request of interim District Attorney Jeffrey Froehlich, the Wisconsin Department of Justice agreed to take over the prosecution of the case.
