On February 27, 1983, the U.S. Secret Service Protective File was implemented by the FBI/NCIC. This new file has been designed to assist the U.S. Secret Service (USSS) in its efforts to protect the President and other authorized protectees. This file will help provide the whereabouts of those individuals who may pose a threat to a protectee and advise the USSS of an individual’s criminal activity that may be related to one of the protectees.
The USSS alone will have the authority to enter a record into NCIC on an individual who is a dangerous threat to the President and/or other protectees who are afforded USSS protection as authorized by 18 USC3056 and Public Law 90-331 as amended.
Any terminal agency making an inquiry, entry, or modification containing a searchable identifier that matches an identifier of a person within the USSS File, will receive the USSS record in the response from NCIC in addition to any other response. The USSS headquarters in Washington, D.C. will also receive the hit notification.
A USSS RESPONSE DOES NOT AUTHORIZE THE ARREST, CUSTODY OR DETENTION OF THE NAMED INDIVIDUAL.
Extreme caution must be exercised by agencies receiving a USSS record response to avoid liability situations. The USSS response must be viewed as advisory only and does not authorize any action by the inquiring agency. The USSS response also advises that “THIS INFORMATION CANNOT BE DISSEMINATED OR USED FOR LICENSING AND EMPLOYMENT PURPOSES.”
