Protection Order and Injunction Types

Entries into this file are based on the following types:

1.  Domestic Abuse – Temporary restraining orders and Injunctions issued under state statute 813.12. An injunction under this subsection is effective according to its terms, for the period of time that the petitioner requests, but not more than 4 years. Injunctions under this statute prohibit possession of a firearm

2.  Child Abuse – Temporary restraining orders and Injunctions issued under state statute 813.122. The child victim or a parent, stepparent or legal guardian of the child victim may be a petitioner under this section. An action under this section may pertain to more than one child victim. An injunction under this subsection is effective according to its terms, but for not more than 2 years or until the child victim attains 18 years of age, whichever occurs first. Injunctions under this statute prohibit possession of a firearm.

3.  Harassment - Temporary restraining orders and injunctions issued under state statute 813.125. An injunction under this subsection is effective according to its terms, but for not more than 2 years. Injunctions under this statute may or may not prohibit the possession of a firearm.

4.  Vulnerable Adult – Temporary restraining orders and injunctions issued under state statute 813.123. The vulnerable adult, a parent, an adult sibling, an adult child or the legal guardian of the vulnerable adult or a county protective services agency may be a petitioner under this section. An injunction under this subsection is effective according to its terms, but for not more than 2 years.

5.  Foreign – Entries of this type are orders or injunctions issued by courts in other jurisdictions or states. A foreign protection order shall be accorded full faith and credit by the courts in this state and shall be enforced as if the order were an order of a court of this state if the order meets specific conditions. A copy of any foreign protection order may be filed in the office of the clerk of circuit court of any county of this state. The clerk shall treat any foreign protection order or modification so filed in the same manner as a judgment of the circuit court. A foreign protection order or modification of the foreign protection order that meets the requirements has the same effect as an order issued under, 813.122, 813.123  or. Such an order may or may not prohibit possession of a firearm. An agency should specify in the remarks or miscellaneous field what jurisdiction issued the order and the reason for the order.

6.  Other – Entries of this type are orders or injunctions issued under various other Wisconsin statutes.  If an entry indicates the type of order as “other” the entry must also then specify what state statute the order was issued under.  Examples include orders to enforce physical placement of children under ss. 767.242, orders issued during the course of various civil or criminal proceedings, etc.

Categories are very important to the protection order or injunction entry. The category chosen determines if the computer automatically places a caveat on the record regarding firearm possession. In addition, category chosen upon entry allows the computer to automatically reference on the printout the state statute the order or injunction was issued under.
