Act 109 increased the minimum fine for second offense drunk driving from $300 to $350 dollars and the maximum from $1000 to $1100. On third and subsequent offenses fines are increased for high Blood Alcohol Concentration. Having children under age 16 in motor vehicle while OWI will result in felony charge. Fifth offense OWI should be charged as a felony.
