Statute/ORD. Citation

List the corresponding statute number for the offense now being charged.  If an ordinance violation, the word “ORD” should be used.

In many instances, criminal complaints include statute citations for both the offense and penalty sections.  Fingerprint cards should be submitted using the offense statute rather than the penalty statute.  Penalty statutes often state penalties for more than one specific offense.  By including the offense statute the precise elements of the offense are reported and available.  The severity of the offense will be indicated in the elsewhere on the fingerprint card.  If the criminal complaint indicates the defendant is charged with Theft under 943.20(1)(a) and 943.20(3)(a), only the offense section; 943.20(1)(a) need be reported.  943.20(3)(a) identifies the offense as a class A misdemeanor.
