Juvenile Waivers

A fingerprint card submitted to CIB indicating the subject is a juvenile but is checked treat as an adult will cause the disposition to be left open waiting for a disposition from the court.

A fingerprint card submitted to CIB indicating the subject is a juvenile without an indicator to treat as an adult will automatically default to a disposition of turned over to juvenile authorities.  The booking agency should still obtain and complete a disposition form, including the ATN, at the time of booking should the juvenile be subject to waiver at a later time.  Local policy between the booking agency, prosecutor and court should determine whether the booking agency hold the disposition pending waiver or forward with the case file.  If the subject is waived, the disposition should follow the case through court to eventually be reported to CIB.  When the court submitted disposition is received by CIB, the submitted court disposition will be used to overwrite the automatically applied juvenile disposition.  If the juvenile is not waived the disposition should be destroyed.  This process eliminates the need for the booking agency to notify CIB independently that a juvenile has been waived.
