Final Dispositions

Clerk of Court Completion of Final Disposition

The contents of this section give instructions for those courts that are submitting paper dispositions to CIB.  For those courts submitting via the Consolidated Court Automation Program (CCAP), see Electronic Submission of Court Disposition.

The Final Disposition Report is filed along with other appropriate case papers with the Clerk of Court when proceedings commence.  When the case is adjudicated and a final disposition is reached the Clerk of Court must indicate the final disposition by completing the Final Disposition block.  The following are choices for completing this form with the required information.

1.  Convicted or Guilty

2.  No Prosecution (Complaint Denied)

3.  No Prosecution (First Offender Program)

4.  No Prosecution (Read In)

5.   No Prosecution (Restitution) Amount not needed

6.  No Prosecution (Restitution & Read In) Amount not needed

7.  Dismissed

8.  Dismissed (First Offender Program)

9.  Dismissed (Read In)

10. Dismissed Restitution - Amount not needed

11. Dismissed Restitution & Read In - Amount not needed

12. Dismissed Consolidated - List new charges

13. Acquitted (Found Not Guilty)

14. Deferred Prosecution  Submit final case disposition

15. Not Guilty by Reason of Mental Defect

16. Incompetent to Stand Trial

17. If probation state "probation" with length and effective date.  NOTE: Whenever probation is revoked you should notify the CIB and give the new sentence.

18. If prison sentence state "prison" with length, effective date and location if known.

19. If waived to adult court state "waived to adult court" and give date of waiver.

20. If charge was amended from the original indicate "amended charge" and list new charge.

21. If charge was prosecuted as something other than the original charge indicate "prosecuted charge" and list new charge.

22. Fine - Amount not needed

23. Fine & Restitution - Amount not needed

24. Jail Sentence - State "Jail" and give length of sentence

25. Jail with Huber - State "Jail with Huber" and give length of sentence.

26. If original sentence has been "Stayed" or "Withheld" you should indicate as such and furnish the new sentence given.

27. Community Service - Do not need to list details.

28. Intensive Sanctions - State "Intensive Sanctions" and give length of sentence.

29. Electronic Surveillance - State "Electronic Surveillance" and give length of sentence.

30. Conditional Probation 961.47 (1) - State "Conditional Probation" and give length of sentence and fine.  Notify if revoked.

31. Special Disposition 973.015 - State "Special Disposition" and give length of sentence and fine.  Notify if revoked.

NOTE: All Final Disposition Reports that are not clearly or completely filled out will be returned to the clerk of court or agency that submitted them for clarification.
