Charge/Citation (Literal, Statute No. or Ordinance, NCIC Code)

REQUIRED  This space is to record the state statute corresponding to the literal charge.  When the charge is made for a local ordinance violation, enter "local ord" rather than cite the specific number of the local ordinance.  The statute numbers must appear exactly the same as they appear on the fingerprint card submitted to the CIB.

Record the NCIC OFFENSE code which corresponds to the "Literal Charge" and "statute/ord"  information.  THE NCIC OFFENSE CODE MUST BE EXACTLY THE SAME AS THE NCIC CODE ON THE RELATED FINGERPRINT CARD SUBMITTED TO THE CIB.

In many instances, criminal complaints include statute citations for both the offense and penalty sections.  Fingerprint cards should be submitted using the offense statute rather than the penalty statute.  Penalty statutes often state penalties for more than one specific offense.  By including the offense statute the precise elements of the offense are reported and available.  The severity of the offense will be indicated in the elsewhere on the fingerprint card.  If the criminal complaint indicates the defendant is charged with Theft under 943.20(1)(a) and 943.20(3)(a), only the offense section; 943.20(1)(a) need be reported.  943.20(3)(a) identifies the offense as a class A misdemeanor.
